Terms of Service

Last updated: 21 October 2026

These Terms of Service (“Terms”) are a legal agreement between you and the developer of Improva (“Improva”, “the App”, “we”, “us”, or “our”) governing your use of the Improva iOS application. Please read them carefully.

1. Acceptance

By installing, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not install or use the App.

2. What the App does

Improva is a fitness and accountability app for iOS. Its features include:

  • Linking scheduled gym behaviour to Screen Time blocking of apps and categories you choose.
  • A weekly planner for workouts, cardio sessions, and focus blocks, with optional multi-day scheduling.
  • A workout timer with rest and break tracking and Lock Screen Live Activities.
  • Nutrition tracking, including calories, macronutrients, micronutrients, a barcode scanner, and a meal-plan generator.
  • A research-based strength program generator and a research-based running coach with plan generation, reassessment, and heart-rate-variability-informed adjustments.
  • Progress tracking, streaks, an emergency-code safeguard, optional local backup and restore, and optional Apple Watch integration.

Some features require Premium, a paid upgrade described in section 7.

We may add, change, or remove features over time.

3. Eligibility

You must be at least 16 years old to use the App. If you are under 18, you should use the App only with the involvement of a parent or guardian. Some features are restricted by age within the App itself: weight-loss calorie targets are not offered below 18, supplement-related guidance is presented only to users 18 and older, and the running coach does not build marathon or ultramarathon plans below 18. By using the App you confirm that you meet these requirements.

4. Not medical, health, or professional advice

Improva provides general fitness and nutrition information for educational and informational purposes only. It is not medical advice and is not a substitute for advice from a qualified physician, dietitian, or other healthcare professional.

Calorie and macronutrient targets, training and running prescriptions, heart-rate zones, calorie-burn estimates, and supplement guidance are estimates derived from population-level research. Individual needs vary substantially with metabolism, body composition, health status, medication, genetics, and other factors, and the App’s estimates may not be right for you.

You should consult a qualified healthcare professional before starting or changing any exercise, nutrition, or supplementation program, and especially if you have or may have a medical condition, take medication, are pregnant or breastfeeding, are recovering from injury, or are under 18.

5. Assumption of risk and safety

Exercise carries an inherent risk of injury. By using the App, you knowingly and voluntarily accept that risk and take responsibility for training safely and within your ability.

  • Stop immediately and seek help if you experience pain, dizziness, chest discomfort, shortness of breath, or any unusual symptom.
  • Use appropriate technique, equipment, spotters, and safety collars, particularly for heavy compound lifts.
  • Do not train through joint or lower-back pain.
  • The “I’m at the gym” location check is a convenience feature that confirms proximity to a location you set. It is not a safety, supervision, or emergency system, and must not be relied upon as one.

You are solely responsible for deciding whether the App’s recommendations are appropriate for you.

6. Your data and backups

The App stores your information on your device, as described in the Privacy Policy. You are responsible for your device, for any backup files you create, and for keeping copies of anything important to you. Resetting your data, deleting the App, letting Premium lapse (which removes the plans Premium generated for you), losing or replacing your device, or a device fault may result in permanent loss of your data. We cannot recover it, because we do not hold a copy.

7. Premium, purchases, and the free trial

What Premium includes. App blocking and accountability, the running coach, the strength program generator, the meal-plan generator, cardio trends and readiness, and the fortnight overview require Premium. Everything else in the App is free.

Products. Premium is sold through Apple’s App Store as:

  • Premium Yearly - an auto-renewable subscription billed once a year.
  • Premium Lifetime - a one-time purchase that does not renew or expire.
  • Premium Lifetime (Creator) - the same one-time purchase at a lower price, available only after you enter a valid creator code.

Prices are shown in the App Store, in your local currency, before you confirm a purchase, and may differ by country. Payment is charged to your Apple Account when you confirm the purchase.

Auto-renewal and cancellation. Premium Yearly renews automatically at the end of each yearly period until you cancel it. Your Apple Account is charged for the renewal within the 24 hours before the current period ends, unless you turn off auto-renewal at least 24 hours before the end of the current period. You can cancel or manage the subscription at any time in your Apple Account’s subscription settings (on iPhone: Settings, then your name, then Subscriptions). Cancelling stops the next renewal; Premium stays active until the end of the period you have already paid for.

The free trial. When you finish the App’s setup tutorial for the first time, Premium is unlocked free for 3 hours. The trial is not a subscription: it requires no payment details, does not convert into a paid purchase, and ends by itself. It is available once per device, including after you delete and reinstall the App.

When Premium ends. If the trial ends, or a subscription ends or is refunded, without another Premium purchase, app blocking and accountability are turned off and plans Premium generated for you (an active running plan, an active strength program, and meal plans for future weeks) are removed. Fortnight overviews stay in your history, but opening one needs Premium. Anything you built or logged yourself is kept.

Restoring and refunds. You can restore purchases made with the same Apple Account from the App’s settings. Payments are processed by Apple, so refund requests are made to Apple under its refund process (for example at reportaproblem.apple.com); we cannot issue refunds ourselves.

Your consumer rights. Nothing in this section excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded, including a remedy where a purchase does not meet a consumer guarantee. Section 11 applies to purchases as it does to the rest of the App.

8. Acceptable use

You agree to use the App only for its intended personal, non-commercial purpose, and not to misuse it, interfere with its operation, attempt to circumvent its safety or accountability features other than through the means the App itself provides, or use it in violation of any applicable law.

9. Third-party services and content

  • Open Food Facts. The barcode scanner retrieves nutrition information from the Open Food Facts database. That data is crowd-sourced and may be incomplete or inaccurate; you should verify it. Your use of that lookup is also subject to Open Food Facts’ own terms and privacy practices.
  • Food and recipe data. Some ingredient and recipe information is derived from publicly available sources, including public-domain U.S. government datasets (such as USDA FoodData Central). Improva is not affiliated with, endorsed by, or sponsored by the USDA or any government agency. Rights in third-party datasets remain with their holders. If you believe content in the App infringes your rights, contact us and we will address it promptly.
  • Diet and allergen filters. The meal-plan generator’s diet filter and its option to hide recipes containing common allergens run over ingredient information derived automatically from recipe ingredient lists. That information may be incomplete or wrong. Always check the full ingredient list yourself, and do not rely on these filters to manage a diagnosed allergy, intolerance, or coeliac disease.
  • Apple services. Features that rely on HealthKit, Screen Time, iCloud, notifications, and similar Apple frameworks are also subject to Apple’s terms.

Nutrition, training, and calorie figures throughout the App are estimates and are labelled as such where shown.

10. Intellectual property

The App, including its source code, design, branding, original written content, and original recipes, is owned by the developer and protected by law. You may not copy, modify, distribute, sell, sublicense, reverse-engineer, or create derivative works from it, except as expressly permitted by these Terms or by applicable law that cannot be excluded.

11. Disclaimer of warranties

To the maximum extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that its estimates and recommendations will be accurate or suitable for you.

Nothing in these Terms, including section 7 on purchases, excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, it is limited to the maximum extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by law, and subject to the paragraph above, the developer of Improva will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from:

  • personal injury or health outcomes arising from exercise, nutrition, or supplementation decisions informed by the App;
  • loss of, or inability to recover, data on your device or in a backup;
  • inaccuracies in calorie, macronutrient, training, calorie-burn, or other estimates;
  • consequences of the App’s app-blocking or accountability features, including missed communications or reduced productivity.

13. Changes to the App and these Terms

We may update, suspend, or discontinue the App or any feature at any time. We may also update these Terms; when we make a material change we will update the effective date and surface it in the App, and your continued use after that constitutes acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State, without limiting any right you have to bring proceedings in the jurisdiction where you live if applicable law entitles you to do so.
